Apple and Samsung can’t even agree where to sit during trial

Think the courtroom is the wrong place for a game of musical chairs? Not if you’re Samsung. 

Even with millions of dollars in damages on the line, Samsung and Apple are arguing over something as small as where their lawyers will sit, reports AllThingsD.

The heart of the problem is this: While Apple is suing Samsung, and Samsung is also suing Apple, it’s Samsung that’s being called the “defendant” in the case — something it’s not crazy about.

“Both parties will at times be acting as plaintiffs and both as defendants, and it is therefore important that both parties are treated the same,” Samsung said in a Thursday filing.

Samsung’s fear is that the proximity of the plaintiff’s chair to the jury might make the jury more sympathetic towards Apple’s case.

As a result, Samsung proposes a solution: The judge should allow its lawyers to sit in the plaintiff’s chair while they argue their case against Apple. The company also wants both parties to be referred to as “claimants” rather than plaintiffs and defendants.

Samsung says that its suggestions will ensure that both companies get equal consideration from the jury, but at this rate they’re more likely to just get on the judge’s nerves.
